Chief Justice Dhananjay Chandrachud: Judgment on Shiv Sena at the time? Not during the tenure of Chief Justice Chandrachud

Shiv Sena's case is pending in the Supreme Court for many years. It has become crucial to decide who Shiv Sena belongs to. In this case, important hearings are going on in the Supreme Court.

A bench headed by Chief Justice of India DY Chandrachud on Tuesday heard the arguments of both the parties in the Shiv Sena symbol case.

Shiv Sena's claim to the party's name and symbol has been going on for a long time in the Supreme Court. After the rebellion of Eknath Shinde, two factions have been formed in Shiv Sena. One faction is led by Eknath Shinde, while the other is led by Uddhav Thackeray. Both the factions are claiming the name and symbol of Shiv Sena. The Election Commission had frozen the Shiv Sena's bow and arrow symbol after the two factions staked claim over it.

In today's hearing, the Supreme Court asked both the factions to file a written response to each other's arguments by next Monday. The next hearing will be on December 12. The hearing on this matter will now be held by a five-judge bench. The bench will comprise Chief Justice DY Chandrachud and Justices MR Shah, Krishna Murari, Hima Kohli and PS Narasimha. This means that the decision on the Shiv Sena case may not come during the tenure of Chief Justice Chandrachud.

The term of Chief Justice Chandrachud will end on November 9, 2024. If the Shiv Sena case is not decided by then, a new bench will have to be constituted to hear the case. This could further delay the decision in the case.
